Please read carefully these General Terms and Conditions of Sale and use of the website www.athleas.com (“Website”). This document contains important information about the user’s rights and obligations.


TERMS AND CONDITIONS OF SALE

These Terms and Conditions apply when purchasing ATHLEAS products offered on the Website. The products displayed on the Website are manufactured and sold by Intimidea S.r.l.
The manufacturer and/or the seller are entitled to update these Terms and Conditions of Sale at any time and without notice. By placing an order through the Website, the user agrees to the Terms and Conditions of Sale in effect on the date of the order submission.

1) Purchase Orders
The website www.athleas.com allows orders of ATHLEAS products from all European Union countries.
Purchases are strictly reserved for private customers for personal use; any resale or distribution activity is strictly prohibited.
Images and colors of the products published on the site are true to reality, but slight variations may occur due to the settings of the user’s device. ATHLEAS is not responsible for any discrepancies related to such technical differences.
Offers regarding product prices and availability are valid while supplies last. In the event that the ordered product is unavailable, the customer will be promptly notified and may choose to replace it with another item or cancel the order and receive an immediate refund.
Before confirming the order, the customer will receive a summary with details of the selected items, quantities, and prices. It is the customer’s responsibility to carefully check this information before submitting.

2) Order Confirmation – Binding Agreement
Orders will only be considered valid after written confirmation by ATHLEAS, sent via email. Upon confirmation, the order and these Terms and Conditions of Sale constitute a binding agreement between customer and seller.
Orders cannot be modified or canceled after confirmation, except as required by law or provided in these Terms. Data recorded by the website constitutes full proof of the transaction. In case of dispute, electronic records will serve as definitive evidence.

3) Prices and Payment Methods
Prices are expressed in Euro (€) and do not include shipping costs unless otherwise stated. ATHLEAS reserves the right to change prices at any time, without notice, applying in any case the rates in effect at the time of order confirmation.
Payment must be made at the time of order confirmation and can only be made in Euro (€) through:

  • Credit/debit cards (supported by Moneta Web)
  • Apple Pay
  • PayPal
  • Bank transfer

4) Shipping and Delivery
Products are shipped to the address provided by the customer during the order process. Any errors or changes after submission will not be borne by ATHLEAS.
Shipping is available throughout the European Union and is free of charge for both Italy and other EU countries.
Delivery dates are indicative: any delays cannot generate liability for ATHLEAS, except in cases directly attributable to the seller.
In case of non-delivery attributable to ATHLEAS, the customer may choose between:

  • a new shipment at no additional cost;
  • a full refund of the purchase price.

Upon delivery, the customer must check the accuracy of the order and the integrity of the package. Any anomalies (e.g., damaged or missing items) must be noted and reported promptly.

5) Return Policy
Always keep all original packaging materials, boxes, and documentation, as they are necessary for returns. Items returned without original packaging cannot be accepted.
At the time of delivery, it is necessary to verify that the shipment is correct. In case of discrepancies (e.g., damaged package or non-conforming item), the issue must be reported on the delivery note. If the product does not match the order or the customer is not satisfied, a return or refund may be requested under the following conditions.

5a. Returns
The user has the right to return a product ordered via the Website within 10 (ten) calendar days from the delivery date.
Return shipping costs are borne by the customer. Items must be new, unused, intact, free of odors (smoke, perfume, detergents, lotions, etc.), and in the original packaging. Worn, damaged, or unpackaged items will not be accepted.

5b. Refunds
Refunds will be processed within 10 (ten) business days of receipt and verification of the returned goods. The refunded amount will equal the original purchase price, excluding shipping costs. 5c. Replacements
Items returned in suitable condition and in the original packaging may be exchanged for products of equal value. In case of size, color, or model error, replacement will only be possible if the return is made within the terms and conditions described above.

5d. Manufacturing Defects
Items with obvious manufacturing defects must be returned for evaluation by the manufacturer. If the defect is confirmed, the customer will be immediately contacted to arrange refund or replacement. For more information, please visit the dedicated page HERE.

6) Disclaimer of Liability
The seller and/or manufacturer shall in no case be liable for special, indirect, consequential, or incidental damages of any kind resulting from:

  • defects or malfunctions of the products;
  • breach of warranties, express or implied;
  • contractual defaults;
  • torts (including negligence);
  • product liability or other similar causes.

This applies even if the seller or manufacturer has been informed of the possibility of such damages.
Some jurisdictions do not allow limitations or exclusions of liability for incidental or consequential damages: in such cases, this limitation may not apply to the individual customer.
In any case, the overall liability of the seller and/or manufacturer, for any reason (contract, warranty, tort, or otherwise), shall never exceed the amount actually paid by the customer for the purchase of the products giving rise to the liability.

7) Force Majeure
The seller and/or manufacturer shall not be held responsible for delays or inability to deliver due to force majeure, including but not limited to:

  • acts of civil or military authorities;
  • wars, riots, strikes, or other labor disputes;
  • natural disasters or shortage of materials;
  • other circumstances not reasonably foreseeable or controllable.

In such cases, the delivery date shall be automatically extended for a period equal to the delay caused by the force majeure event.

Access to and use of the Website are governed by these Terms and Conditions and the Privacy Policy. By using the site, the user agrees to comply with these rules.
The seller and/or manufacturer reserve the right to update or modify the Terms and Conditions of Use and the Privacy Policy at any time, without notice.

1) Security and Personal Data
The use of personal data provided by users is governed by the Website’s Privacy Policy. The seller and/or manufacturer may update the data protection rules at any time in accordance with applicable regulations. The site is not intended for individuals under 18 years of age.

2) Intellectual Property
All content on the Website (texts, images, videos, logos, registered or unregistered trademarks, domain names) is the exclusive property of the manufacturer.
The following are prohibited:

  • reproduction, distribution, publication, transmission, or sale of content without written authorization;
